在国内层面，《商业秘密保护规定》正式落地，专利法（含SEP相关规范）持续完善。特别是2026年4月7日正式公布的《中华人民共和国反外国不当域外管辖条例》，为中国企业反制外国“长臂管辖”提供了强有力的制度支撑 。

在国际层面，全球标准必要专利（SEP）规则正加速重构。美国明确将车企联合谈判的汽车联盟定性为垄断并严厉禁止；欧盟新版技术转让指南则取消了针对被许可人的原有安全港机制。欧美主要经济体不断强化SEP执法，并激烈争夺全球许可费率裁定权，导致中国企业海外诉讼风险持续攀升。

As 2026 marks the opening year of China’s 15th Five-Year Plan, global industrial development and compliance competition are entering a new phase. Against this backdrop, the highly anticipated 2026 Industry Innovation & IP Strategy Summit will be grandly held in Shenzhen, China, this November. Centered on the theme of “New Rules, New Landscape,” this year’s summit will closely track the direction of global industrial transformation, address the pressing reality of escalating overseas litigation risks, and provide clear guidance for Chinese enterprises pursuing high-quality global expansion.

“New Rules” & “New Landscape”: Reshaping the Global Intellectual Property Competition Ecosystem

“New Rules” refers to adjustments in policies and regulatory frameworks, while “New Landscape” focuses on shifts in industry dynamics and the international order. At present, intellectual property policies and regulations in China and abroad are undergoing profound rounds of revision and restructuring:

At the domestic level, the Provisions on the Protection of Trade Secrets have officially come into force, while the Patent Law, including rules related to standard-essential patents (SEPs), continues to be refined. In particular, the Regulation of the People’s Republic of China on Countering Foreign Countries’ Unlawful Extraterritorial Jurisdiction, officially issued on April 7, 2026, provides strong institutional support for Chinese enterprises in responding to foreign “long-arm jurisdiction.”

At the international level, the global framework for standard-essential patents (SEPs) is being rapidly reshaped. The United States has explicitly characterized automotive alliances formed for joint negotiations by carmakers as monopolistic and imposed strict prohibitions on such arrangements. Meanwhile, the EU’s revised Technology Transfer Guidelines have removed the previous safe harbor mechanism available to licensees. Major Western economies are continuously strengthening SEP enforcement and fiercely competing for the authority to determine global royalty rates, causing overseas litigation risks for Chinese enterprises to rise steadily.

Against this complex and fast-changing international regulatory environment, this year’s forum aims to bring together leading industry insights, provide in-depth interpretations of new Chinese and international rules, deliver precise analysis of the evolving industrial landscape, and help address the compliance challenges facing Chinese enterprises in their global expansion.

This session will focus on new SEP enforcement trends in major economies such as the EU and the U.S., as well as the global competition over jurisdiction for royalty-rate determinations. Leading legal scholars, government regulators, judicial experts, senior in-house counsel from renowned companies, and experienced European lawyers will be specially invited to gather and deeply analyze core controversial topics such as SEP implementation and the escalation of anti-monopoly regulation.

Construction and Operation of Domestic Industry Patent Pools

In the track of new energy, Chinese innovation has reached the forefront of the world. Patent pools autonomously led and built by domestic industries have become a hot topic in industry development. For Chinese enterprises, the establishment of industry patent pools requires not only continuously strengthening technological innovation capabilities, but also ensuring the compliant and orderly transformation of patent assets, achieving a two-way balance between innovative development and patent monetization. Moreover, constructing a fair, reasonable, and non-discriminatory unified fee mechanism is the fundamental core for the long-term stable operation of patent pools. Therefore, this session specially invites mainstream domestic patent operation institutions to gather together to jointly explore standard and long-acting operation paths for Chinese patent pools, helping our country’s new energy industry to grow steadily and continuously enhancing the core competitiveness of Chinese industries in the global market.

Eco-Salon on the Intellectual Property for Green Technologies

Closely aligned with the key industrial agenda of the opening year of the 15th Five-Year Plan period, this salon will explore new pathways for intellectual property transformation and protection in the green and low-carbon transition. Representatives from the World Intellectual Property Organization (WIPO) and China WIPO GREEN PARTNER will gather to conduct in-depth exchanges and share experiences on green technology innovation, green technology transfer and transformation, WIPO arbitration and mediation, and high-level honors such as the Global Awards.

Practical Workshop on Offensive and Defensive Strategies for Trade Secret Protection

Against the backdrop of the implementation of the Provisions on the Protection of Trade Secrets and the rise of new technologies, this workshop will examine practical strategies for trade secret protection from criminal, civil, and administrative perspectives. It will focus on the challenges brought by the implementation of new rules and the application of emerging technologies such as artificial intelligence, offering comprehensive practical guidance and rights-protection solutions.

Intellectual Property Governance and Innovation Development in Artificial Intelligence

Based on the global wave of AI technology innovation, this session focuses on core issues including the ownership of AI-generated content, data IP compliance, boundaries of large model training, and protection of algorithmic innovation. It brings together industry leaders, judicial and IP experts worldwide to explore pathways for innovation protection, advance the building of a global, full-chain IP governance system, and empower the high-quality development of new quality productive forces.

At present, the preparation work for the summit has been fully launched, with guest invitations, topic planning, enterprise recruitment, and cooperation issues advancing synchronously.
